Ms. Foundation for Women maintains this website (“materials, electronic products and/or services”) in order to provide you with information about our work, and to enable you to interact with us online. This Linking and Use Agreement describes our understanding with you when you visit our website and use our materials, electronic products and and/or services. YOUR USE OF THE WEBSITE, OUR MATERIALS, ELECTRONIC PRODUCTS AND SERVICES AND/OR DOWNLOADING OF MATERIALS FROM OUR WEBSITE CONSTITUTES YOUR AGREEMENT TO THE TERMS AND CONDITIONS SET FORTH HEREIN.

Ms. Foundation for Women’s website, our materials, electronic products and/or services have several features. In addition to providing descriptions of our programs and how we help women and girls, the website provides you with the opportunity to shop online or interact with us and download links for use on your website. ACCESS TO THE APPROVED BANNERS AND LINKS IS PROVIDED AT THE END OF THIS AGREEMENT. We encourage you to read the entire policy as it sets forth our understanding with you when you visit our website. These terms and conditions have been developed for your protection, as well as ours.

Throughout this policy, you will see the terms “Ms. Foundation for Women,” “we,” “our,” and “us” – these terms refer to Ms. Foundation for Women, Inc., a New York non-stock corporation with tax-exempt status pursuant to Internal Revenue Code Section 501(c)(3). You will also see the terms “I,” “you,” “your,” and “yours” — these terms refer to visitors to and users of our Website. In the United States, Ms. Foundation for Women is the sole owner of the name “Ms. Foundation for Women” which is a registered trademark. Your use of the name and logo and/or links bearing the name and logo acknowledges Ms. Foundation for Women’s exclusive ownership of the name and/or right to use the logo. All use of or goodwill associated with the name, logo, our materials, electronic products and/or services will inure to the benefit of Ms. Foundation for Women or its licensors. The logo, electronic products and services are provided without warranties of any kind, express or implied, including without limitation, warranties of title or non-infringement. Use of our materials, electronic products and/or services provided at the site is solely at your own risk.

1. LINKING TO THE MS. FOUNDATION FOR WOMEN WEBSITE AND USE OF WEBSITE MATERIALS, NAME AND LOGO, AND TECHNOLOGY

Ms. Foundation for Women appreciates informational and educational uses of the Ms. Foundation for Women website, our materials, electronic products and/or services, including our name and logo. However, there are limits on the uses, including the use of the name and logo and the links bearing the name and/or logo.

PLEASE BE AWARE: by copying and/or downloading material from the Ms. Foundation for Women website, name and logo, links bearing our name and the logo and/or using our electronic products and/or services you agree to the terms and conditions set forth in this Terms of Use and Linking Agreement and any terms and conditions that may be outlined elsewhere on our website. Without limiting any other terms or conditions, the permission to use the Ms. Foundation for Women website, materials, electronic products and/or services, including our name and the logo and/or links bearing the name and logo, is subject to the following:

a) Use of the name and logo or links bearing the name and logo may not indicate or create an impression that Ms. Foundation for Women endorses, approves, sponsors or is affiliated with your products, goods, services or your website.

b) Your use of the name and logo or links bearing the name and logo may not indicate or create an impression that Ms. Foundation for Women will benefit from the sale of any good or service.

c) Links bearing the name and logo may only be used for the purpose of linking to the Ms. Foundation for Women website as designated within the link.

d) The links bearing the name and logo will always be active links.

e) The name and logo and/or link bearing the name and logo may not be combined with any other graphic elements; nor may they be altered in any manner including size, proportions, font, design, arrangement, colors or elements; nor may they be animated, morphed or otherwise distorted in perspective or appearance.

f) The name and logo and/or link bearing the name and logo may not appear more prominently than your personal, company, product or service website name.

g) You will not transfer, assign, sell, reproduce, distribute or otherwise exploit the name and logo or your link to us.

h) The Ms. Foundation for Women name and logo and/or link bearing the name and logo may not appear on any pages of any websites that include content or advertising that would be deemed offensive to women or for anti-abortion messaging, tobacco, pornography, religious material, or firearms.

i) Appropriate action by Ms. Foundation for Women may include, but is not limited to, the revocation of the right to use the name and logo and/or any links bearing the name and logo, in which event you agree to remove the name and logo and/or the links bearing the name and logo within TWO business days of notice of revocation.

It is improper, and may be a violation of law, for you to post or download and distribute any material that you do not own or for which you do not have permission to use. PLEASE BE AWARE: violation of someone’s copyright, trademark, or other intellectual property rights may subject you to civil and/or criminal penalties.

2. INAPPROPRIATE USE OF MS. FOUNDATION FOR WOMEN MATERIALS, ELECTRONIC PRODUCTS AND SERVICES AND/OR TECHNOLOGY

It is inappropriate to use the Ms. Foundation for Women website, our materials, including the Ms. Foundation for Women name and logo, electronic products and/or services for illegal, inappropriate, or obscene purposes, or in support of such activities.

We define these terms as follows:
“Illegal activities” are those that violate laws, regulations and/or private agreements, including federal or state laws governing charitable activities, copyright laws, trademark laws, license agreements or other intellectual property rights.

“Inappropriate uses” are any uses other than as permitted by this Terms of Use and Linking Agreement, or as may be permitted elsewhere on our website.

“Obscene activities” are those that violate generally accepted social standards for use of this type of material or technology. PLEASE BE AWARE: Ms. Foundation for Women may seek appropriate action to terminate any uses of our material, electronic products and/or services including, but not limited to the name and logo and links bearing our name and logo, in the event we, in our sole discretion, determine that your use does not conform to any of the conditions of this Terms of Use and Linking Agreement or as provided elsewhere on our website; infringes any intellectual property or other rights of Ms. Foundation for Women or a third party; adversely affects Ms. Foundation for Women’s image, reputation and/or our products, services or programs; violates any applicable law, regulation or ordinance; and/or, is a prohibited activity.

Listed below are some, but not all, prohibited activities that may result in action by Ms. Foundation for Women:a) Posting, transmitting, or facilitating in the promotion of illegal content through our website or electronic products and services.

b) Using our website, our material, electronic products and/or services to harass, threaten, embarrass, or do anything else to another visitor or third party that is unwanted.

c) Transmitting or facilitating distribution of content that is untrue, threatening, harassing, abusive, racially or ethnically offensive, vulgar, sexually explicit, obscene, defamatory, or objectionable to women.

d) Using the name and logo or links bearing the name and logo on websites which Ms. Foundation for Women finds, in its sole discretion, to be objectionable or which includes obscene, violent, intolerant, tasteless, denigrating or sexually oriented content or materials.

e) Disrupting the flow of any chat or social media areas with vulgar language, abusiveness, or other conduct that may disrupt normal activities.

f) Pretending to be anyone whom you are not. You may not impersonate Ms. Foundation for Women staff, or anyone else.

g) Attempting to get a password, other account information, or other private information from others, or harvest e-mail addresses or other information.

h) Posting any unsolicited content or designs, including advertising and promotional materials, at our website.

3. MISCELLANEOUS

a) Ms. Foundation for Women reserves the right to make any change to the information and/or license provided herein at any time for any reason. You acknowledge and agree that you are responsible for keeping up with any such changes.

Mississippi: The official registration and financial information of Ms. Foundation for Women may be obtained from the Mississippi Secretary of State’s office by calling 1-888-236-6167. Registration by the Secretary of State does not imply endorsement by the Secretary of State.

New Jersey: INFORMATION FILED WITH THE ATTORNEY GENERAL CONCERNING THIS CHARITABLE SOLICITATION AND THE PERCENTAGE OF CONTRIBUTIONS RECEIVED BY THE CHARITY DURING THE LAST REPORTING PERIOD THAT WERE DEDICATED TO THE CHARITABLE PURPOSE MAY BE OBTAINED FROM THE ATTORNEY GENERAL OF THE STATE OF NEW JERSEY BY CALLING (973) 504-6215 AND IS AVAILABLE ON THE INTERNET AT www.njconsumeraffairs.gov/ocp.htm#charity. West Virginia: West Virginia residents may obtain a summary of the registration and financial documents from the Secretary of State, State Capital, Charleston, WV 25305. The Ms. Foundation for Women (“Ms. Foundation,” “we,” “our,” “us”) respects the privacy of users of our website and other online services, such as our social media sites and applications. This Privacy Statement describes how the Ms. Foundation collects, uses, discloses, and shares the information you provide.

AGREEING TO OUR PRIVACY STATEMENT

By visiting the Ms. Foundation’s website or using our other online services, you agree to the terms of this Privacy Statement, as may be amended from time to time, and to the transfer of your personal and sensitive information to, and processing and maintenance in, the United States of America. Social media sites: The Ms. Foundation may also collect personal information that you make available through your interaction with us on social media sites such as Facebook, LinkedIn, YouTube, and Instagram.

Ms. Foundation uses the personal information you provide for the purposes for which you provide it.  We may also use it to send you information about the Ms. Foundation activities and news, to help us provide a more personalized and improved experience when you interact with our website, and other ways including:

  • To contact you regarding or to complete donations or purchases
  • To contact you regarding employment, volunteer, or internship opportunities
  • To reply to your requests for information or other assistance
  • To inform you of changes to our policies or terms
  • To communicate with you about upcoming events, initiatives, or other activities
  • To provide news about the Ms. Foundation for Women and our impact on the movement for gender equality and women’s economic justice, reproductive justice, and safety

Aggregating Information.  In addition to personal information you provide through our website and other online services, the Ms. Foundation may collect your personal information offline, through direct mail, telephone, or face-to-face communications to help provide services to you. The Ms. Foundation may aggregate or merge your personal information collected from offline and/or third-party sources, including currently existing information from our records, into a single record.

OTHER INFORMATION WE COLLECT FROM OR ABOUT YOU

Our website may automatically collect information about your visit on its server logs or through our other online services, including such information as your IP address, unique device identifiers, browser type, browser language, referring URL, pages viewed, links clicked, and similar information.

HOW WE SHARE YOUR INFORMATION AND WORK WITH THIRD PARTY VENDORS

In order to provide users of our website with certain services and goods, to help us receive and manage data, to operate our website and other online platforms, to deliver communications to users, and provide other services, we contract with third-party companies and individuals (“third party,” “third parties”).

Commitment to Donors

Donors may contact us to remove their names and contact information from any lists that the Ms. Foundation may exchange as described below (see “Updating Preferences and Opting Out of Receiving Certain Information”).  This policy applies to information received both online and offline by the Ms. Foundation concerning donors.  To the extent donations are processed through a third-party, we require that donor information be used only for purposes necessary to process the donation.

Sharing Information.  Ms. Foundation will not sell or rent your personal information.  The ways that the Ms. Foundation may share your personal information include:

  • Credit Card Transactions, Electronic Fund Transfers, Payments by Check or Money Order, Online Transactions; and Other Services. The Ms. Foundation hires third parties to provide credit card, bank, payment and information processing, order fulfillment, and other services. If you choose to make an application for employment, make a donation online, by phone, through the mail or by other means, make a purchase online, or participate in other activities, we will share your personal information with our service providers as necessary to provide the services.  We require third party service-providers to hold personal information in confidence and to use it only for the purpose provided.
  • Necessity. If we have reason to believe there has been inappropriate interference with or use of our website, communications, charitable services or personal or real property (for example, see Terms of Use), or if we have reason to believe that one of the Ms. Foundation website users, donors, employees or other related parties may have been injured or may have harmed another party, and for similar reasons, we may disclose, without notice to you, personal information as we determine in our good faith judgment is appropriate or is compelled by law enforcement or a legal or regulatory authority.
  • Merger, Acquisition or other Corporate Restructure. We also may transfer your personal information to a third party successor in interest if we are involved in an acquisition, merger or other transfer of control or sale of assets.

Third-Party Links.  Our website may include URLs that link to other websites. When you leave the Ms. Foundation’s website, we do not control the website to which you are linked. For example, when you click on a service provider’s name at the Ms. Foundation’s website, you will be connected with the third-party website (even if the Ms. Foundation’s name/logo is on the screen). This service provider website should have its own privacy policy applying to transactions at its website.  It is important, therefore, that you review privacy policies and terms of use on third-party sites carefully, before you use any services or programs offered.

COLLECTING INFORMATION FROM PERSONS UNDER AGE 18

We do not knowingly collect or solicit personal information from persons under age 18. If you are younger than 18 years, please do not send any information about yourself to the Ms. Foundation, including your name, address, telephone number, or email address.

INFORMATION SECURITY

Ms. Foundation strives to use reasonable administrative, technical, and physical measures to safeguard the personal information we collect from our users.  We use layered security in our systems and designate employees who should have access to “hard copies.”  Online transactions are conducted on an encrypted transcription page using SSL (Secure Socket Layer) before transmission.  On encrypted pages, a “closed” lock symbol is displayed in the bottom part of your browser screen and the website address in the address bar at the top of the browser screen starts with an “https” instead of an “http.”  If you do not see a transaction page with the SSL encryption in place, or if you have concerns about the security of sensitive information, do not send your information to us electronically.  No information system or transmission over the internet can be 100% secure, so we cannot guarantee the security of your personal information.

CHANGES TO PRIVACY STATEMENT

From time to time, the Ms. Foundation may revise our Privacy Statement to address changing technology, security measures and website functionality. We strive to provide you with timely notice of these changes by posting changes to our Privacy Statement on our website or sending other notice that we think is appropriate to the change.  Your use of our website or other online services after we have posted changes indicates your agreement to the revised Privacy Statement.  Please contact us if you have any questions about changes to our practices.

COOKIES; GOOGLE ANALYTICS

Cookies.  A cookie is a text file that is sent to your browser from the Ms. Foundation’s server and stored on your computer’s hard drive. Cookies are used to collect information about a user’s activities on our website and a user’s preferences.  The Ms. Foundation uses two different types of cookies: session-based and persistent cookies. Session-based cookies expire at the end of a browser session, so once you close your browser the cookie simply terminates. Persistent cookies remain on your computer until you remove them. Persistent cookies are used to provide internal website analytics. If you do not want our online services to collect information through cookies, you can set your web browser preferences to reject or delete cookies from our online services. Depending on the browser you use (such as Chrome, Internet Explorer, Firefox, Edge, or others), you can set your preferences by checking the “Help” or “Options” menu to make changes.  If you disable cookies, certain functionality on the website may not work as intended.

Google Analytics. The Ms. Foundation’s website and online services use Google Analytics to analyze data on our website. You may opt-out of Google Analytics by visiting Google Analytics Opt-Out Browser Add-On and downloading the application for your browser.

Updating Preferences and Opting Out of Receiving Certain Information. If you wish to change your privacy preferences or to opt out of receiving certain communications, you may contact us to update your records as follows:

When you receive an email regarding upcoming events, donations, or activities from the Ms. Foundation through our online services, you may either use the link provided at the bottom of the email to unsubscribe from future communications, or you may use this link to unsubscribe.
