Forty years after Roe v. Wade, a Women’s Right to Access Abortion Care is Under Attack

It has been 40 years since the landmark decision in the Roe v. Wade case guaranteed the right to abortion. However, the relief that women experienced following the 1973 decision was short-lived. In 1976, the Hyde amendment was passed, systematically excluding low-income women, including many women of color, from federally funded coverage of abortion care. The denial of Medicaid-funded abortions was the first of many restrictions that would be enacted – essentially stripping away a women’s ability to make personal decisions about her body.

Since 1976, the battle for control of women’s bodies has not relented. Insidious restrictions, many of which have been enacted at the state level over the past two years, have had a devastating effect on women’s reproductive rights. In 2011, states enacted a record 92 laws restricting abortions in 24 states. In 2012, we saw the second-highest number of restrictions on reproductive rights ever, with 43 new provisions enacted in 19 states.

The resurgence of legislation that makes accessing an abortion extremely onerous must be stopped. While attacks on reproductive rights are waged mostly state by state, philanthropic support has been disproportionately awarded to national efforts. Sensitive to this disconnect, the Ms. Foundation for Women focuses 80% of our support at the state and local levels.
